Is Life After Bankruptcy Really That Bad?
Coping with Bankruptcy's Aftermath
Many people overlook that despite some challenges, bankruptcy can truly offer a fresh start. Yet, some remain discontented despite its benefits.
Here's a letter I received:
- Why does it take attorneys six or more weeks to process a Chapter 13 discharge?
- Why do landlords hold bankruptcy against tenants when rent isn't included in the bankruptcy filing?
- If life post-bankruptcy is so difficult, why do lawyers often encourage filing? (Perhaps because they want to get paid.)
My Response:
Six weeks for a discharge may seem long, but it often aligns with the court's schedule.
Landlords might hesitate to rent to individuals with poor credit, fearing they won’t get paid. Evictions are costly and time-consuming, and while they may regain their property, recovering unpaid rent can be challenging. It's understandable for landlords to be cautious, as their income is at stake.
However, life after bankruptcy isn't that bleak. Historically, debtors faced jail time and lifelong stigma. Many during the Great Depression went to great lengths to repay their debts as a matter of honor.
Today, society views it differently. Post-bankruptcy, you can rebuild credit, and your debts are cleared. It's a chance to start anew.
Remember, it was your financial decisions that led to the debt, be it bad luck, planning, or spending habits. You didn't fulfill the repayment contract.
Now, you're largely free from financial stress. Although challenges remain, you likely anticipated them before filing. You sought legal counsel independently; no one pressured you. With your discharge, embrace the opportunity to restart and accept any consequences.
Things could certainly be worse.
In my view, this person might benefit from a change in perspective.
