Buy-to-Let: A Positive Shift for Landlords
Life might soon become much simpler for UK landlords if a Law Commission report, nearing final draft, is implemented.
If you own or plan to invest in a buy-to-let property, it’s crucial to stay informed about proposed changes in tenancy legislation. These changes aim to alleviate many legal hassles associated with rental agreements.
The demand for rental properties is steadily growing, attracting new investors and prompting many specialized lenders to offer buy-to-let mortgage packages. With an abundance of advice and funding available, entering the market is becoming easier?"and now, rental contracts might also become more straightforward. Many landlords and tenants agree this change is overdue.
Currently, there are over twenty different types of rental contracts, many of which date back over a century and include outdated and irrelevant clauses. Despite their age, these are still legal contracts that can be used.
The most common contract used by private landlords is the assured shorthold tenancy agreement, in place since 1988. It outlines rental levels, damage liability, and rules regarding pets and parking. However, landlords have often tailored this agreement with various terms, resulting in numerous versions.
The Law Commission’s proposals, if enacted, would simplify this by reducing the contracts to two types. The first, known as a secure contract, would suit social housing tenants. The second, a private standard agreement, would be for private landlords.
While updating old assured shorthold tenancies won’t be mandatory, it seems logical. In disputes, courts would likely favor the clear terms of the new private standard agreements. Additionally, new repossession rules will enhance flexibility for landlords needing to sell the property urgently, whereas current rules allow tenants a six-month tenure.
Overall, these changes promise to greatly simplify the process for current and future landlords, marking a positive shift in the rental market.
